Terms and Conditions
‘FSC or FSC Group’ shall mean the Forest Stewardship Council A.C. and its subsidiaries.
‘contestants’ shall mean any individual submitting an application to the contest.
‘winners’ shall mean the winners of this contest.
The Forest Stewardship Council® is a global, not-for-profit organization dedicated to the promotion of responsible forest management worldwide. It is construed as a membership organization based on three pillars: the environmental chamber, which includes environmental NGOs such as WWF and Greenpeace, the businesses chamber, which contains businesses such as Tetra Pak and Mondi PLC and the social chamber, consisting of social organizations such as the National Aboriginal Forestry Association of Canada. In addition, members include forest owners and managers, processing companies and campaigners, and individuals.
The membership consensus sets the FSC Principles and Criteria - the highest standards of forest management which are environmentally appropriate, socially beneficial and economically viable. For more information on the Forest Stewardship Council please visit our website www.fsc.org.
About the contest
The FSC Social Media Contest 2013 aims at celebrating the UN International Day of Forests and raising awareness on the importance of the world’s forests and trees.
This edition of the FSC Social Media Contest is themed: “0321 What is your connection to the Forest?” and reaches out to any Facebook® user who meets the eligibility requirements as outlined below.
The United Nations General Assembly has proclaimed 21 March the International Day of Forests. Describe your connection to the forest in a video, image, or writing and share it with the world. Submissions must be made in only the FSC official languages: Spanish and English. Submissions in other languages will be accepted.
The contest begins on 15 February 2013 and consists of two phases:
1. Phase one
Applications for the first phase of the FSC Social Media Contest 2013 must be received on 0321 at fsc point org by the 21 March 2013, 11:59:59 CET (noon). For the particular requirements regarding the applications please see below (‘How to apply’).
Late applications will not be accepted. FSC is not responsible for applications which are lost, damaged or late due to computer, network or telecommunications failure.
After the celebration of the UN International Day of Forests on 21 March 2013, and until the end of April 2013 a jury made up of four members of the FSC International Secretariat will assess the applications and the best videos, pictures and stories will qualify for the second phase. Selection criteria will be particularly: creativity, originality, expression and execution of the theme. The selected contestants will be called “Finalists”.
The Finalists will be informed by FSC via email that their artwork has passed the first phase. Thereaftee, the list of Finalists will be published on our Facebook Page at the beginning of May.
2. Phase two
The announcement of the Finalists at the beginning of May 2013 will initiate the second phase of the contest. The selected artwork will be uploaded to a Facebook voting platform and made available to the Facebook community. The voting platform is accessible through the FSC Facebook page and the FSC website at www.fsc.org. . During the next month each Facebook User will have the possibility to assess the competing artwork and vote for their favorites (voting will be limited to one vote per day per user). In order to be able to vote, each Facebook User will need to log-in to the voting application. For more information regarding applications please see here.
The three artworks with the most valid votes will win the contest. The winners will first be notified via email. Thereafter the name and country of origin of the winners shall be published on the FSC website, the FSC Facebook Page and the Facebook Voting Platform. Additional information about the winners may be requested.
Apart from the closing date valid for the receipt of the applications (21 March 2013, 11:59:59 CET (noon)) all other timeframes remain indicative at the current stage and will be confirmed with sufficient notice by the FSC Panel at a later stage.
Winners will be awarded with targeted prizes related to the artwork and the winner. FSC may, at its own discretion, publish the winning artworks in important media, on its website and/or on other social media platforms.
The prize is not transferrable, exchangeable or redeemable in cash and must be accepted as awarded.
How to enter the competition
The contestants can participate by creating an artwork (video, a picture or a story) related to the topic of the Contest (My connection to the forest) and submitting this within the timeframe mentioned above to 0321 at fsc point org. The creations must be original artwork produced by the contestant free of any prior claims or rights.
- Video: film, animation, or other moving images. Videos shall not exceed one minute of length and shall be hosted on an external platform (e.g. youtube, vimeo, dailymotion, etc.). The submission shall contain the link to the video and a short explanation about the video background (max. 1 min length - video description max. 150 characters).
- Images: are photos, drawings and paintings. Each image data shall not exceed 9 MB and shall be accompanied by a short description (max. 150 characters).
- Writing: stories or poems. Writing shall be submitted in word format or in portable document format (pdf) and shall not exceed 250 words.
The contestant warrants that the artwork submitted for competition does not include material that is copyrighted, protected by trade secret or otherwise subject to third parties’ intellectual property rights and does not violate publicity rights, or the privacy of any person, living or deceased, or otherwise infringe upon any third party’s personal or proprietary rights. Artwork must be suitable for publication in a public forum and must not contain nudity, profanity or threats of violence. Artwork must furthermore not serve advertising purposes for products and services, whether commercial or non-commercial, of particular businesses or economic interests or be inappropriate in any other way.
The contest is open to every individual who
- is a registered member of Facebook, and
- has reached the age of legal majority in his/her country of origin or permanent residence, at least, however, is 18 years or older,
Members and staff of the FSC Group, its National Offices and their immediate kin are not eligible to participate in the contest.
By entering the contest and submitting their application to 0321 at fsc point org, contestants verify that they meet these eligibility criteria and that all information they submitted is true, accurate and complete. They agree to abide and be bound by the competition rules and the decisions made by the jury, which are final in all matters relating to this contest.
Ownership and use of results
Ownership of the idea and its implementation results, including industrial and intellectual property rights, and of the documentation relating to it shall be vested in the beneficiary.
Without prejudice to the generality of the foregoing, the contestants grant the FSC Group a perpetual, transferrable, irrevocable, worldwide, royalty-free, and non-exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, and publicly display any artwork that the contestant submits as part of this contest for any purpose.
FSC at its sole discretion may require evidence of the winner's ability to grant the license set forth above.
By submitting their artwork, contestants declare that they have obtained or will obtain all authorizations, consents and permissions necessary to submit their artwork and comply with these terms and conditions and, to the best of their knowledge, that their artwork will not infringe any intellectual property or other third party rights or breach any contractual obligation.
FSC will not be liable for any claims that an artwork infringes upon the intellectual property or other rights of any party and the contestant agrees to indemnify and hold FSC harmless from all such claims.
Contestants agree to participate in any publicity and promotional activities that FSC may reasonably request.
Contestants agree that personal data including, but not limited to, name, mailing address and email address, may be collected, processed, stored and otherwise used for the purposes of conducting and administering this contest.
The winners agree that FSC shall have permission to use any winner's name, likeness and entry for advertising, publicity and other purposes, in any and all media now or hereafter known, without further notice or compensation, except where prohibited by law.
Contestants will have the right to access, review, rectify or cancel any personal data held by FSC in connection with the contest by writing an email to 0321 at fsc point org. All personal data shall be handled according to German legislation on data protection. If a contestant does not provide the required data when requested, that contestant’s application will be ineligible for any prizes. In case the winner cannot be contacted within ten (10) working days after its determination or in the event he/she is not able to comply with these terms and conditions, the prize is deemed to have been forfeited. In such a case, a redraw will be conducted.
Each winner shall have sole responsibility for complying with any legal obligations incumbent on him/her.
Except in cases of force majeure, each winner shall make good any damage sustained by the FSC as a result of the execution or faulty execution of the artwork.
Contestants shall bear sole liability vis-à-vis any third party, including for damage of any kind sustained by them during the duration of the contest and thereafter. Contestant agrees to indemnify, defend and hold harmless FSC and its subsidiaries, its National Offices and affiliates, and all officers, directors, employees and agents of the aforesaid entities, from any and all claims and costs, including attorneys’ fees, relating to, arising from or in connection with participation in this contest or the receipt or use of any prize. In so doing, contestant releases and indemnifies the aforesaid entities and individuals from liability for injuries or damages of any kind arising from or in connection with the participation in this contest or the receipt or use of any prize. In no event shall FSC be liable to a contestant for acts or omissions arising out of or related to the contest or a contestant’s participation in the contest.
Law and jurisdiction
This contest shall be governed by these terms and conditions and by the laws of Germany. Any dispute arising from, or related to, this contest, including these terms and conditions, shall be subject to the exclusive jurisdiction of the courts of Cologne, Germany.
By submitting its application and entering the contest each contestant agrees to submit to the terms and conditions above.
